ASSUMPTION OF RISK, RELEASE OF LIABILITY, PHOTO RELEASE, AND PARTICIPANT AGREEMENT

By registering for and/or participating in a Downtown Wellness & Mindful event, I acknowledge and agree to the following:

I understand that this event may include physical activity, including but not limited to yoga, stretching, breathwork, sound bath meditation, fitness activities, wellness workshops, demonstrations, and other related activities. I understand that participation involves inherent risks, including but not limited to muscle strain, falls, dizziness, dehydration, allergic reactions, illness, emotional distress, disability, property damage, or death.

I voluntarily assume all risks associated with my attendance and participation in this event and acknowledge that I am solely responsible for determining my physical fitness and ability to participate. I certify that I have no medical condition that would prevent my safe participation, or that I have consulted with an appropriate medical professional prior to participating.

I agree to participate at my own pace, listen to my body, and discontinue participation if I experience pain, discomfort, dizziness, illness, or any other concern.

I understand that this event may take place outdoors and may involve exposure to sun, heat, weather conditions, uneven surfaces, and other conditions commonly associated with public spaces. I agree to take reasonable precautions, including bringing water, wearing appropriate clothing, and using sun protection as needed.

I acknowledge that food and beverages may be provided as part of the event. I understand that it is my responsibility to disclose any food allergies, sensitivities, or dietary restrictions and that I voluntarily assume all risks associated with the consumption of food and beverages provided at the event.

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless the El Paso Downtown Management District, AO Ventures, LLC d/b/a Sushiitto Japanese Cuisine, WestStar Tower, the property owners, landlords, tenants, sponsors, vendors, instructors, contractors, volunteers, event organizers, board members, officers, employees, agents, affiliates, successors, assigns, and partners from any and all claims, demands, causes of action, liabilities, losses, damages, costs, expenses, attorney's fees, or judgments arising out of or related to my attendance at or participation in the event, including claims resulting from negligence, except where prohibited by law.

I acknowledge and agree that the El Paso Downtown Management District, AO Ventures, LLC d/b/a Sushiitto Japanese Cuisine, WestStar Tower, and their respective affiliates are not responsible for any lost, stolen, or damaged personal property, vehicles, valuables, equipment, or belongings brought to or left at the event.

I agree to assume full responsibility for any medical expenses, emergency transportation costs, hospital bills, rehabilitation expenses, lost wages, or other costs incurred as a result of injury, illness, or damages sustained during or related to the event.

I understand that photographs, video recordings, and other media may be captured during the event for promotional, marketing, educational, and archival purposes. By participating, I grant permission to the El Paso Downtown Management District and its partners to use my image, likeness, voice, and appearance in print, digital, social media, website, advertising, and promotional materials without compensation or further approval.

By registering for or participating in this event, I acknowledge that I have carefully read, fully understand, and voluntarily agree to the terms of this Assumption of Risk, Release of Liability, Photo Release, and Participant Agreement.
